Patent Office Extends Deadlines to June 1, 2020

Our last post explained how the US Patent and Trademark Office allowed people a waiver of certain deadlines” for due dates between March 27, 2020, and April 30, 2020.

Now they have even further extended this time period. saying today that all Patent and Trademark due dates that would have been due between March 27, and June 1, 2020 are now “considered timely if filed on or before June 1, 2020.”, provided that an Applicant can show that a “person associated with the filing or fee was personally affected by the COVID-19 outbreak, including, without limitation, through office closures, cash flow interruptions, inaccessibility of files or other materials, travel delays, personal or family illness, or similar circumstances, such that the outbreak materially interfered with timely filing or payment. “

This allows for “free” extensions of all patent office (and trademark office) due dates if Covid was any part of the cause.

As before, however, this does not protect applicants from Statutory Bars to patentability.

So chin up! At least the patent office is extending our due dates!
